{"id":2210,"date":"2024-05-10T12:15:31","date_gmt":"2024-05-10T12:15:31","guid":{"rendered":"https:\/\/xonar-homes.com\/termos-e-condicoes\/"},"modified":"2024-05-10T13:41:00","modified_gmt":"2024-05-10T13:41:00","slug":"terms-conditions","status":"publish","type":"page","link":"https:\/\/xonar-homes.com\/en\/terms-conditions\/","title":{"rendered":"Terms and Conditions"},"content":{"rendered":"\n\t<section class=\"section\" id=\"section_231144676\">\n\t\t<div class=\"bg section-bg fill bg-fill  bg-loaded\" >\n\n\t\t\t\n\t\t\t\n\t\t\t\n\n\t\t<\/div>\n\n\t\t\n\n\t\t<div class=\"section-content relative\">\n\t\t\t\n\n<div class=\"row\"  id=\"row-450054365\">\n\n\n\t<div id=\"col-2140991277\" class=\"col small-12 large-12\"  >\n\t\t\t\t<div class=\"col-inner\"  >\n\t\t\t\n\t\t\t\n\n<div class=\"row\"  id=\"row-1194779303\">\n\n\n\t<div id=\"col-1403328725\" class=\"col small-12 large-12\"  >\n\t\t\t\t<div class=\"col-inner\"  >\n\t\t\t\n\t\t\t\n\n\t<div id=\"text-2385161215\" class=\"text\">\n\t\t\n\n<h1><strong>Terms and Conditions<\/strong><\/h1>\n\n\t\t\n<style>\n#text-2385161215 {\n  font-size: 2.5rem;\n}\n<\/style>\n\t<\/div>\n\t\n\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\n\t\n\n<\/div>\n\t<div id=\"text-436139636\" class=\"text\">\n\t\t\n\n<div>\n<h2>Article 1 \u2013 Definitions<\/h2>\n<p>In these terms and conditions shall apply:<\/p>\n<ul>\n<li>Rom Algarve Actividades Hoteleiras Lda. or \u201cXonar\u201d.<\/li>\n<li>\u201cOwner\u201d the rightful owner of the rental accommodation.<\/li>\n<li>\u201cManager\u201d a designated person by the owner or property management company who acts on their behalf.<\/li>\n<li>\u201cAccommodation\u201d house or villa that the client rented or intends to rent through Xonar on behalf of the owner or property management company.<\/li>\n<li>Tenant or \u201cClient\u201d, the person who rented or intends to rent the accommodation through xonar.<\/li>\n<li>\u201cLease\u201d a rental contract between the Owner and the Tenant through Xonar.<\/li>\n<\/ul><\/div>\n<div>\n<h2>Article 2 \u2013 General Conditions<\/h2>\n<p>These terms and conditions apply to all offers, quotations, contracts and services provided by Xonar or through Xonar. All agreements and conditions must be in writing.<\/p>\n<p>Xonar reserves the right to change these terms and conditions unilaterally.<\/p>\n<\/p><\/div>\n<div>\n<h2>Article 3 \u2013 Nature of the Agreement<\/h2>\n<p>3.1 \u2013 Xonar mediates in the creation of a lease between the Owner or Property Management Company and the Client, Xonar is explicitly not a party to the lease.<\/p>\n<p>3.2 \u2013 Reservations are made by Email, and confirmed with the deposit payment, payable to Xonar (see Article 4).<\/p>\n<p>3.3 \u2013 The Accommodation must be in good condition to be used and the equipment available in good working order.<\/p>\n<p>3.4 \u2013 The number of people defined in the reservation must be respected.<\/p>\n<\/p><\/div>\n<div>\n<h2>Article 4 \u2013 Payment<\/h2>\n<p>4.1 \u2013 The reservation is only confirmed after the payment of a 30% deposit.<\/p>\n<p>4.2 \u2013 The remaining 70% plus any additional charges is due 8 weeks before the rental starts.<\/p>\n<p>4.3 \u2013 Reservations made within 8 weeks before arrival are only confirmed after the payment of the full amount.<\/p>\n<p>4.4 \u2013 The delay of payments within the defined deadlines may lead to the cancellation of the reservation.<\/p>\n<p>4.5 \u2013 If Xonar does not have the full agreed amount paid on the day of arrival, Xonar is entitled to deny the Client access to the accommodation, without prejudice to the right Xonar has for full payment of the agreed amount (see Article 7).<\/p>\n<\/p><\/div>\n<div>\n<h2>Article 5 \u2013 Additional Costs<\/h2>\n<p>Any additional costs such as:<\/p>\n<ul>\n<li>Security deposit<\/li>\n<li>Extra cleaning service<\/li>\n<li>Tourist tax<\/li>\n<\/ul>\n<p>Is due to be paid on arrival directly to the Owner or Manager in cash, or to Xonar if indicated on the invoice issued.<\/p>\n<\/p><\/div>\n<div>\n<h2>Article 6 \u2013 Use of the Accommodation<\/h2>\n<p>6.1 &#8211; The Client must behave as a responsible Tenant.<\/p>\n<p>6.2 \u2013 The Client must comply with the rules of the accommodation according to the instructions of the Owner or the Manager or Xonar.<\/p>\n<p>6.3 \u2013 Only the persons whose names are on the booking form are entitled to use the accommodation.<\/p>\n<p>6.4 \u2013 Only with the written permission of Xonar can the accommodation be used for commercial purposes such as:<\/p>\n<ul>\n<li>Photo shoots<\/li>\n<li>Videos<\/li>\n<li>Weddings<\/li>\n<li>Receptions<\/li>\n<\/ul>\n<p>6.5 \u2013 The client must respect the arrival (16:00) and departure (10:00) times as indicated on the booking form. For different arrival or departure times the Client must contact Xonar. Any costs related to different arrival or departure times are the responsibility of the Client.<\/p>\n<\/p><\/div>\n<div>\n<h2>Article 7 \u2013 Cancellation<\/h2>\n<p>7.1 \u2013 In the event of a cancellation of the booking by the client, the following rules apply:<\/p>\n<ul>\n<li>Cancellation after confirmed booking \u2013 30% of the agreed amount<\/li>\n<li>Cancellation between 8 and 6 weeks from arrival date &#8211; 50% of the agreed amount<\/li>\n<li>Cancellation after 6 weeks of arrival date \u2013 100% of the agreed amount<\/li>\n<\/ul>\n<p>7.2 \u2013 Xonar reserves the right to change the cancellation rules mentioned above but only in favour of the Client.<\/p>\n<\/p><\/div>\n<div>\n<h2>Article 8 \u2013 Termination or Modification of the Agreement<\/h2>\n<p>8.1 \u2013 In the case of force majeure events, over which Xonar has no control, such as acts of terrorism, war, natural disasters, or others, and which makes it impossible to travel to or remain in the destination, Xonar will not assume any responsibility or make any refund of the amount already paid.<\/p>\n<p>8.2 \u2013 In the event that the client does not behave responsibly and does not comply with the rules of use of the accommodation, and after being warned either by the Owner, or by the Manager or Xonar, Xonar reserves the right to terminate the contract early without giving rise to any refund.<\/p>\n<\/p><\/div>\n<div>\n<h2>Article 9 \u2013 Responsibility<\/h2>\n<p>9.1 \u2013 Xonar mediates the rental between the Client and the Owner or the Property Management Company, not being an integral part of the lease.<\/p>\n<p>9.2 \u2013 Xonar accepts no responsibility for:<\/p>\n<ul>\n<li>Theft, loss or damage of any kind during or after a stay at one of our accommodations.<\/li>\n<li>Breakdown of any technical equipment in the accommodation.<\/li>\n<li>Impossibility of using electricity, water, internet or any other service provided by external suppliers.<\/li>\n<li>Information errors or photos provided by the Owner or Property Management Company.<\/li>\n<li>Works or accidents around the accommodation.<\/li>\n<\/ul>\n<p>9.3 \u2013 The Client assumes the responsibility for the use of the Accommodation during their stay and will return the accommodation in the same conditions that it was received at the beginning of the stay. An inventory will be made before arrival and after use, in case there is damage or extra costs, they will be charged to the Client.<\/p>\n<p>9.4 \u2013 In case of misuse of the accommodation, or excess dirt, the additional costs will be charged to the client.<\/p>\n<\/p><\/div>\n<div>\n<h2>Article 10 \u2013 Complaints<\/h2>\n<p>10.1 \u2013 In the event of a complaint on the Client\u00b4s part, it must be submitted to the Manager or the Owner in the first instance in order to find a solution.<\/p>\n<p>10.2 \u2013 In case the Manager or the Owner is unable to find a solution, the Client must contact Xonar within 48 hours, Xonar will try to find a solution.<\/p>\n<p>10.3 \u2013 Complaints received after the end of the stay will not be considered by Xonar.<\/p>\n<p>10.4 \u2013 The Client must always give Xonar the opportunity to propose a suitable solution to the complaint. Early departure from the accommodation without prior consultation does not entitle the client to any refund.<\/p>\n<p>10.5 \u2013 If the complaint is not satisfactorily resolved, the Client must put their complaint in writing. With as much information as possible and send it to Xonar no later than 4 weeks after the departure date.<\/p>\n<\/p><\/div>\n<div>\n<h2>Article 11 \u2013 Final Provision<\/h2>\n<p>These terms and conditions are governed by Portuguese law.
